Subject to your compliance with these Terms, Powerfantasy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the Services solely for your personal, non-commercial entertainment purposes on devices owned or controlled by you.

To protect the integrity of the Services and ensure a fair gameplay experience for all users, we use third-party anti-cheat software and security monitoring tools ("Anti-Cheat Software"). By accepting these Terms and using the Services, you expressly acknowledge and consent to the installation and operation of the Anti-Cheat Software on your device during your use of the Services.
The Anti-Cheat Software may collect and transmit information relating to your device hardware and software configuration, in-game process activity, memory state, gameplay behaviour patterns, and account data to us and our security service providers, for the sole purpose of detecting cheating, unauthorised modifications, fraud, and other violations of these Terms. This data collection is a necessary condition of accessing the Services and cannot be disabled while you are connected to the Services.
Full details of the data collected by the Anti-Cheat Software, the third-party providers used, and the legal basis for processing are set out in our Privacy Policy. If you do not consent to this data collection, you must discontinue use of the Services.
The Services may include a virtual, in-game currency ("Virtual Currency") that may be purchased for real money or earned through gameplay. Virtual Currency can be used to obtain virtual goods, items, enhancements, or other digital content (collectively, "Virtual Items") within the Services.

All purchases of Virtual Currency or Virtual Items are final and non-refundable, except as required by applicable law (including consumer protection laws in certain jurisdictions). By completing a purchase, you authorise us to charge the applicable fees to your designated payment method.

Subject to applicable law, all purchases are final. Upon termination or suspension of your account for any reason, you will forfeit all Virtual Currency and Virtual Items associated with your account without compensation, except as required by applicable law. You retain ownership of any content, materials, information, messages, images, or other data that you create, upload, submit, or transmit through the Services ("User Content"). By submitting User Content, you grant Powerfantasy a worldwide, royalty-free, irrevocable, perpetual, sub-licensable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating and promoting the Services.
You are solely responsible for your User Content. You represent and warrant that your User Content does not:
We do not guarantee that we will monitor User Content, but we reserve the right (but not the obligation) to review, screen, edit, refuse, or remove any User Content at our sole discretion and at any time, without notice.
All right, title, and interest in and to the Services, including all content, software, graphics, user interfaces, logos, trademarks, and other materials contained therein ("Powerfantasy Content"), are owned by or licensed to Powerfantasy HK Limited. The Services are protected by copyright, trademark, and other intellectual property laws of Hong Kong and applicable jurisdictions worldwide.
Nothing in these Terms grants you any right, title, or interest in the Powerfantasy Content or any intellectual property rights therein, other than the limited licence expressly granted in Section 4. All rights not expressly granted herein are reserved by Powerfantasy.
"Powerfantasy", the Powerfantasy logo, and related marks are trademarks or registered trademarks of Powerfantasy HK Limited. You may not use our trademarks without our prior written permission.

POWERFANTASY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICES.
TO THE EXTENT PERMITTED BY APPLICABLE LAW IN YOUR JURISDICTION, INCLUDING HONG KONG, EUROPEAN UNION, AND OTHER APPLICABLE JURISDICTIONS, POWERFANTASY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICES.
NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY WARRANTIES THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE CONSUMER PROTECTION LAWS IN YOUR JURISDICTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POWERFANTASY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POWERFANTASY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO POWERFANTASY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED HONG KONG DOLLARS (HK$100).
NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION.
If you are a consumer located in the European Economic Area, these limitations may not apply to you to the extent prohibited by applicable consumer protection law.
You agree to defend, indemnify, and hold harmless Powerfantasy, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgements, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of laws provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be subject to good faith negotiation between the parties for a period of thirty (30) days following written notice by either party.
If the dispute cannot be resolved by negotiation, it shall be finally resolved by binding arbitration administered by the Hong Kong International Arbitration Centre ("HKIAC") in accordance with the HKIAC Administered Arbitration Rules in force at the time of the commencement of the arbitration. The arbitral award shall be final and binding on both parties. Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.
To the maximum extent permitted by applicable law, you agree that any arbitration shall be conducted on an individual basis and not as a class or representative action. You waive any right to bring or participate in any class, collective, or representative action.
If you are a consumer located in the European Economic Area, you have the right to bring a claim before the courts of the country in which you are resident, and to use applicable alternative dispute resolution mechanisms, including those provided under EU law. The above arbitration clause does not affect these rights.
To the maximum extent permitted by applicable law, you must bring any claim or cause of action arising out of or relating to these Terms or the Services within two (2) years of the date on which the claim or cause of action arose. Any claim or cause of action not filed within that period shall be permanently barred, without regard to any statute of limitations or other law to the contrary. Nothing in this provision limits your statutory rights as a consumer under applicable mandatory consumer protection laws in your jurisdiction.
These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Powerfantasy with respect to the Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions of these Terms shall continue in full force and effect.
No waiver of any provision of these Terms by Powerfantasy shall be effective unless in writing. No failure or delay by Powerfantasy in exercising any right shall constitute a waiver of that right.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Powerfantasy may freely assign these Terms in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of its assets.
We may provide notices to you by posting on the Services, by email to the address associated with your account, or by other reasonable means. Notices from you to Powerfantasy shall be sent to support@powerfantasygames.com.
You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Powerfantasy shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including without limitation acts of God, natural disasters, epidemics, war, terrorism, governmental action, civil unrest, or power or internet failures.
